Terms and Conditions
These Terms and Conditions apply to goods and services supplied by Jodi Ruckely trading as Our Place on Earth ABN 52 626 769 154
By purchasing goods, booking a consultation, purchasing a digital product or otherwise engaging Our Place on Earth to provide services, you agree to these Terms and Conditions.
1. Prices and GST
All prices are stated in Australian dollars (AUD) unless otherwise indicated.
Our Place on Earth is not currently registered for GST. GST is therefore not charged or included in our prices.
If our GST registration status changes, prices for future goods and services may be adjusted accordingly.
2. Payment
Payment is required at the time of booking or purchase unless another payment arrangement or due date is shown on an invoice.
Where an invoice is issued, payment must be made by the due date stated on that invoice.
If an amount remains unpaid after its due date, Our Place on Earth may suspend further services or fulfilment of an order until payment is received.
Where reasonably necessary, overdue accounts may be referred for recovery. The customer may be responsible for reasonable recovery costs to the extent permitted by law.
3. Consultations
Our Place on Earth provides a holistic, patient-centred approach to animal wellbeing.
Consultations may consider physical, emotional, nutritional, environmental and other factors relevant to an animal's wellbeing.
Where appropriate, we may recommend that diagnostic testing, treatment or further assessment be undertaken by your local veterinarian or another suitably qualified professional.
No particular treatment outcome or result can be guaranteed. Animals respond differently to treatment and recommendations depending on their individual circumstances.
Nothing in these Terms limits our obligation to provide services with due care and skill as required by Australian law.
4. Emergency Veterinary Care
Our consultation service is not intended to replace urgent or emergency veterinary care.
If an animal is seriously ill, injured, distressed or experiencing a veterinary emergency, you should promptly contact your local veterinarian or veterinary emergency hospital.
5. Information Provided by Clients
Clients are responsible for providing complete and accurate information relevant to their animal, including where applicable:
medical and veterinary history;
current medications and supplements;
known medical conditions;
recent diagnostic results;
changes in behaviour, diet or physical condition; and
treatment being provided by other veterinarians or practitioners.
Recommendations may be affected by incomplete or inaccurate information.
6. Appointment Changes and Cancellations
Any applicable cancellation, rescheduling or non-attendance conditions will be disclosed when an appointment is booked.
We ask clients to provide reasonable notice when they need to change or cancel an appointment.
Any cancellation fee does not affect rights or remedies available under the Australian Consumer Law.
7. Goods and Delivery
Physical products, including books, will be supplied to the delivery address provided by the customer.
Any delivery or postage charge will be displayed or advised before the order is completed.
Delivery dates are estimates only and may be affected by postal services, carriers and circumstances outside our reasonable control.
Please contact us if an order arrives damaged, is incorrect or does not arrive within a reasonable period.
8. Digital Products
Digital products, including electronic nutrition charts or other downloadable materials, are supplied for the personal use of the purchaser unless otherwise stated.
Digital products must not be copied, resold, redistributed, published or commercially reproduced without prior written permission from Our Place on Earth.
We are not required to provide a refund merely because a customer changes their mind after receiving or downloading a digital product. This does not limit any rights the customer may have under the Australian Consumer Law.
9. Consumer Guarantees and Refunds
Our goods and services come with rights and consumer guarantees that may apply under the Australian Consumer Law.
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Where required by Australian Consumer Law, customers may be entitled to remedies including repair, replacement, re-supply of services, refund, cancellation or compensation depending on the circumstances.
A change of mind does not automatically entitle a customer to a refund unless we have separately agreed to provide one.
10. Limitation of Liability
To the maximum extent permitted by law, Our Place on Earth is not responsible for indirect or consequential loss resulting from the use of our goods, website information or services.
This limitation does not apply where liability cannot legally be excluded or limited, including applicable rights and remedies under the Australian Consumer Law.
11. Website Information
Information published on the Our Place on Earth website is provided for general information and education.
General website content should not be relied upon as a diagnosis of an individual animal's condition or as a substitute for appropriate veterinary assessment.
We endeavour to keep information accurate and current but do not guarantee that all website information will always be complete or up to date.
12. Intellectual Property
Unless otherwise indicated, the text, photographs, graphics, educational material, digital products and other original content supplied by Our Place on Earth remain the intellectual property of their respective owner.
Purchasing a product or service does not transfer ownership of intellectual property to the purchaser.
Materials may be used for the purchaser's personal purposes but may not be commercially reproduced, distributed or sold without permission.
13. Complaints and Concerns
If you have a concern about a consultation, product, order or other service, please contact us so that we have an opportunity to investigate and resolve the matter.

14. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia, and applicable laws of the Commonwealth of Australia.
Nothing in this clause limits any rights a consumer may have under applicable Australian consumer protection laws.
